Terms of Service

Welcome to PokerLog. These Terms of Service (“Terms”) govern your use of the PokerLog mobile application and related services (“Service”) provided by MoneySense Labs (“we,” “our,” or “us”).

By using PokerLog, you agree to these Terms. If you do not agree, do not use the Service.

1. Description of Service

PokerLog is a poker session tracking application that allows you to:

• Log and track live poker sessions (cash games and tournaments)
• Manage your poker bankroll
• View performance statistics and analytics
• Sync data across devices (with an account)
• Access AI-powered insights (Prime subscription)

2. Eligibility

You must be at least 18 years old to use PokerLog. By using the Service, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms.

Age Verification

By using PokerLog, you confirm that you are at least 18 years old. We reserve the right to request proof of age and to suspend or terminate accounts if we have reason to believe a user is under 18.

PokerLog is intended for tracking legal poker activities only. You are responsible for ensuring that your poker activities comply with the laws of your jurisdiction.

3. Accounts

Registration

You may use PokerLog without an account (local-only mode). To access cloud sync and certain features, you must create an account with a valid email address.

Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

Username

Your username:

• Cannot be changed after account creation
• Must not impersonate others or contain offensive content
• Must not violate any third-party rights

We reserve the right to remove or reassign usernames that violate these Terms.

4. Subscriptions and Payments

Free Tier

PokerLog offers free access to core features including:

• Cash game session tracking
• GTO preflop charts
• Bankroll management
• Basic statistics
• 398 pre-loaded poker room locations
• CSV data export

Prime Subscription

PokerLog Prime is available as:

• Monthly: $11.99/month
• Annual: $99.99/year (save 30%) — includes a 3-day free trial

Prime unlocks:

• Tournament tracking
• AI Stats Assistant
• Cloud sync across devices
• Advanced statistics and analytics
• Multi-table mode
• Priority support

Billing

Apple App Store (iOS)

• Subscriptions are billed through Apple's App Store
• Payment is charged to your Apple ID account at purchase confirmation
• Prices include applicable taxes

Google Play Store (Android)

• Subscriptions are billed through Google Play
• Payment is charged to your Google Play account
• Prices include applicable taxes

Free Trial (Annual Plan)

The annual plan includes a 3-day free trial. Important details:

• You will NOT be charged during the 3-day trial period
• You can cancel anytime during the trial at no cost
• If you do not cancel at least 24 hours before the trial ends, your subscription will automatically convert to a paid annual subscription
• Upon conversion, your payment method will be charged $99.99 for the first year
• To cancel: iOS users go to Settings → Apple ID → Subscriptions. Android users go to Google Play Store → Subscriptions

Auto-Renewal

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions anytime in your device's account settings

Refunds

• iOS: Refund requests are handled by Apple according to their policies at https://support.apple.com/billing
• Android: Refund requests are handled by Google according to their policies at https://support.google.com/googleplay/answer/2479637

Price Changes

We may change subscription prices at any time. Price changes will take effect at the start of the next subscription period after the change. Your continued use constitutes acceptance of the new price.

5. App Store Terms

Apple App Store

Your use of PokerLog on iOS is also subject to Apple's Standard Licensed Application End User License Agreement (EULA), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

You acknowledge and agree that:

• These Terms are between you and MoneySense Labs only, not with Apple Inc.
• Apple has no obligation whatsoever to furnish any maintenance and support services with respect to PokerLog
• In the event of any failure of PokerLog to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to PokerLog
• Apple is not responsible for addressing any claims by you or any third party relating to PokerLog or your possession and/or use of PokerLog, including but not limited to: (a) product liability claims; (b) any claim that PokerLog fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection or similar legislation
• In the event of any third-party claim that PokerLog or your possession and use of PokerLog infringes that third party's intellectual property rights, Apple is not responsible for the investigation, defense, settlement, or discharge of any such claim
• Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary

Google Play Store

Your use of PokerLog on Android is also subject to Google Play's Terms of Service, available at https://play.google.com/about/play-terms/

You acknowledge that:

• These Terms are between you and MoneySense Labs only, not with Google
• Google has no obligation to provide maintenance, support, or warranty services
• Google is not responsible for addressing any claims related to PokerLog

6. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service
• Reverse engineer, decompile, or disassemble the app
• Use automated systems to access the Service without permission
• Submit false or misleading information
• Violate any applicable laws or regulations
• Use the Service to track gambling activities where such activities are illegal in your jurisdiction

7. User Content

Your Data

You retain ownership of all session data, notes, and other content you create in PokerLog (“User Content”).

License

By using PokerLog, you grant us a limited license to store, process, and display your User Content solely to provide the Service to you.

Responsibility

You are solely responsible for your User Content and ensuring it does not violate any laws or third-party rights.

8. Intellectual Property

Our Property

PokerLog, including its design, features, code, graphics, and trademarks, is owned by MoneySense Labs and protected by intellectual property laws.

Limited License

We grant you a limited, non-exclusive, non-transferable license to use PokerLog for personal, non-commercial purposes in accordance with these Terms.

Restrictions

You may not:

• Copy, modify, or distribute the app
• Use our trademarks without permission
• Create derivative works based on the app

9. Disclaimers

“As Is” Service

PokerLog is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, and accuracy or reliability of any information.

No Gambling Advice

PokerLog is a tracking tool only. We do not provide:

• Gambling advice or recommendations
• Guarantees of poker success
• Financial or investment advice

Your poker results depend on your own skill, decisions, and variance. Past performance tracked in PokerLog does not guarantee future results.

Data Accuracy

While we strive for accuracy, we do not guarantee that statistics, calculations, or analytics will be error-free. You are responsible for verifying any important data.

10. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• We are not liable for any loss of profits, data, or goodwill
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim

These limitations apply regardless of the theory of liability and even if we have been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify and hold harmless MoneySense Labs, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, your violation of these Terms, or your violation of any rights of another.

12. Termination

By You

You may stop using PokerLog at any time. To delete your account and data, use the in-app option or contact us.

By Us

We may suspend or terminate your access to PokerLog at any time, with or without cause, with or without notice. Reasons may include violation of these Terms, fraudulent or illegal activity, extended inactivity, or at our sole discretion.

Effect of Termination

Upon termination:

• Your right to use the Service ceases immediately
• We may delete your account and data (subject to our Privacy Policy)
• Provisions that should survive (indemnification, limitation of liability, etc.) will continue to apply

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms in the app
• Updating the “Last Updated” date
• Providing in-app notice for significant changes

Your continued use of PokerLog after changes constitutes acceptance of the new Terms.

14. General Provisions

Governing Law

These Terms are governed by the laws of the State of Illinois, United States, without regard to conflict of law principles.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MoneySense Labs regarding PokerLog.

No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms at any time without notice.

15. Dispute Resolution and Arbitration

Informal Resolution

Before filing any formal dispute, you agree to contact us at support@pokerlog.app and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration

If we cannot resolve the dispute informally, you and MoneySense Labs agree to resolve any claims through final and binding arbitration, except as set forth below. The American Arbitration Association (AAA) will administer the arbitration under its Consumer Arbitration Rules. Arbitration will be conducted in Chicago, Illinois, or remotely via video conference.

Exceptions

Either party may bring a lawsuit in court for:

• Small claims court matters (if eligible)
• Intellectual property disputes
• Injunctive relief

Class Action Waiver

YOU AND MONEYSENSE LABS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Opt-Out

You may opt out of this arbitration agreement by sending written notice to support@pokerlog.app within 30 days of first using PokerLog. Include your name, email, and a clear statement that you wish to opt out of the arbitration agreement.
